Fitbit is recalling its Charge 2 fitness tracker after reports of cracks forming on the device’s display screens. The company says it has received “some consumer inquiries” about incidents related to cracking, which could affect visibility while using the Fitbit app or viewing notifications.
Fitbit says that the Charge 2 display screens are prone to cracking. The company has released a statement on their website, saying they will replace the devices for free if they crack.
Fitbit Charge 2 smart fitness bands are allegedly prone to screen fractures, according to a class action complaint, yet Fitbit refuses to provide repairs or reimbursements to consumers who encounter the problem.
Plaintiff Hillary Schneider claims she paid $149.99 for a Fitbit Charge 2 only to have the display screen break after a few months of usage.
Schneider called Fitbit and notified them of the broken screen, according to the Fitbit class action complaint. In order to make things right, she claims Fitbit gave her a 25% discount on a new fitness band.
Fitbit is in violation of implied guarantee of merchantability, according to the Fitbit fitness band class action, by refusing to repair or replace the device.
Schneider claims she spent too much for the Fitbit Charge 2 since the crack “substantially reduces” its value. The lawsuit claims that she would not have spent almost $150 for a fitness band that might break at any time.
According to the Fitbit Charge 2 class action complaint, “Plaintiffs and the class members have therefore incurred real economic losses as a consequence of Fitbit’s illegal behavior.”
The improved display screen of the Fitbit Charge 2 was one of the main attractions over the Charge HR, according to the Fitbit class action complaint.
“The easy-to-read tap-sensitive display is four times bigger than the original Fitbit Charge HR, so you can view more activity data and keep your fitness goals on track with just a glance,” the firm claims in online promotional ads for the Fitbit Charge 2.
The lawsuit claims that once the fitness band’s aesthetic appeal is lost, the device is “valueless or near-valueless.”
According to the Fitbit Charge 2 class action, it’s impossible to get the “tap-sensitive display” to work correctly with a cracked screen.
Schneider says she isn’t the only Fitbit customer who has had this problem. Several concerns on internet forums are included in the Fitbit class action lawsuit.
“The screen has a fracture on the interior and looks to be breaking. “There was no impact to the watch; I didn’t drop it; it just cracked straight along the center of the screen, as if the screen is growing or stretching and no longer fits the casing,” according to one complaint.
In addition to having the same problem, the Fitbit class action claims that when customers complain about the screen flaw, they are only offered a discount on a new Fitbit device.
Schneider is attempting to represent all Americans who purchased a new Fitbit Charge 2 smart fitness band and subsequently discovered a vertical crack running down the middle of the LCD screen. In addition, the lawsuit seeks to represent a category of Illinois residents.
Sweetnam LLC’s William M. Sweetnam and Natasha Singh are representing the Fitbit user.
Hillary Schneider v. Fitbit Inc., Case No. 1:19-cv-01322, is a class action lawsuit filed in the United States District Court for the Northern District of Illinois, Eastern Division.
