AmeriGas Propane Tanks Settlement — Claim Up to $125 Without Proof of Purchase

The American Gas Association settled a lawsuit against AmeriGas for $125 million without proof of purchase. The settlement was reached because the gas company failed to fix leaky and defective propane tanks and avoid leaks in its customers’ homes — but there is no evidence that any individual plaintiff suffered personal injury or property damage as a result of these issues.

As part of a $6.5 million settlement over the quantity of propane in the tanks, consumers who bought AmeriGas or Blue Rhino pre-filled tanks may be able to recover up to $125 without proof of purchase.

Individuals who purchased or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between December 1, 2009, and November 30, 2020 are entitled to file a claim in this class action settlement.

Class Members will be entitled for up to $2.50 per tank for up to 50 tanks, or $125, if they do not have evidence of purchase. Class members with evidence of purchase are entitled for up to $5 per tank, with no limit on how many tanks they may claim.

This class action settlement resolves allegations that AmeriGas and Blue Rhino conspired to reduce the quantity of propane in their pre-filled propane tanks from 17 pounds to 15 pounds while keeping the price the same, resulting in inflated propane costs for consumers.

While this settlement may impact customers who bought either AmeriGas or Blue Rhino propane tanks, it solely addresses AmeriGas’ claims; the Blue Rhino lawsuit is still pending in court.

With this settlement, AmeriGas agrees to stop the lawsuit, but it does not confess to any wrongdoing. 

Two classes were created as part of the settlement agreement.

Those who purchased AmeriGas or Blue Rhino propane tanks in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah, or West Virginia during the Class Period, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, are part of the Indirect Purchaser Settlement Class.

Consumers who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale, are part of the Direct Purchaser Settlement Class.

On March 31, 2021, a fairness hearing will be held.

The deadline to file a Claim Form, opt out of the settlement, or object to it is March 8, 2021.
