This settlement provides benefits to owners and lessees of Class cars that were initially equipped with or installed with a replacement authentic Theta II 2.0-liter or 2.4-liter gasoline direct injection engine. Vehicles in this category include:

  • Kia Optima models from 2011 through 2018 and some models from 2019;
  • Kia Sorento models from 2012 through 2018, as well as certain 2019 models; and
  • Kia Sportage models from 2011 through 2018, as well as certain 2019 models.

Several Hyundai and Kia cars were allegedly fitted with a faulty Theta engine, according to plaintiffs in the Kia engine failure class action complaint.

 

According to the lawsuit, the cars’ gasoline direct-injection (GDI) fuel system’s connecting rod bearings “have a protracted failure.” Metal debris reportedly “accumulates in the engine oil” when these rod bearings crack, polluting it to the point that the filter is unable to remove it all.

According to the class action complaint, the tainted oil is circulated by the oil pump, weakening engine components and eventually resulting to a “sudden and unexpected catastrophic engine failure.”

As a consequence, the cars were said to be susceptible to engine failures or flames, placing customers at risk of accidents and financial harm.

Several class action lawsuits were brought against the car companies, resulting in the claims being combined into a multidistrict case based in California. Plaintiffs in these cases sought monetary compensation and other benefits for injuries they claimed they suffered as a result of the faulty engines.

Hyundai has not acknowledged any wrongdoing, but has agreed to settle the allegations against its Kia division in a settlement agreement. In a similar agreement, claims of Hyundai engine failure were addressed. The agreements are intended to minimize the expense and dangers of a trial, but they do not implicate Hyundai in any wrongdoing.

Class Members must submit a proper claim form by Aug. 9, 2021, to be eligible for the Kia engine failure settlement.

Class members who suffered engine failure or fire after August 28, 2020, have 90 days from the date of the incident to submit a valid claim form. Engine failures, repairs, and other pertinent information should be documented on claim forms.

Exclusion and objection requests must be sent by Oct. 30, 2020. The Kia engine failure class action settlement’s final approval hearing is scheduled for Nov. 13, 2020.
