Mattress manufacturers have been found to be unintentionally releasing tiny glass fibers into the air every time they construct a new mattress. The good news is that Zinus has developed an innovative solution for this problem, and it’s already in all their mattresses.
The “Zinus mattress lawsuit compensation” is a lawsuit that was filed against Zinus. The company claims that the mattress leaked glass fibers, which led to severe health issues for the plaintiff.
Plaintiffs have launched a class action lawsuit against mattress manufacturer Zinus, alleging that the mattress may open and unleash dangerous glass fibers.
When the outside cover of the mattresses is unzipped, huge glass fibers may pour out, causing severe injury and property damage, according to plaintiffs Amanda Chandler and Robert Durham.
On February 14, 2020, a news segment named “Hidden Hazards” aired on a CBS station in St. Louis, exposing “the risk hiding in your mattress,” according to the Zinus class action complaint. The plaintiffs’ experience in this lawsuit was detailed in the news article, which detailed how the Zinus mattress leaked a significant quantity of glass fibers, inflicting life-threatening damage to their family.
Chandler says she bought the Zinus mattress in the summer of 2019 from a Walmart. She claims the mattress had a zippered outer cover that she could remove. She also claims that the outside cover had a sticker on it that stated, “62 percent Glass Fibers.”
According to the Zinus class action complaint, the mattress tag did not warn the buyer that the outer cover should not be removed, nor that removing the outside cover would expose the contents of the mattress, particularly the glass fibers.
Chandler claims she removed the outer cover of her mattress on January 20, 2020, in order to launder it in her washing machine. Her boys were having fun jumping on the mattress while she was cleaning it, she claims.
Durham, Chandler’s husband, allegedly noted his skin was sore and inflamed the following day. According to the plaintiffs, he found that his whole body was coated with tiny, hard-to-see glass threads at some time.
The plaintiffs say they discovered their whole house was littered with little glass fragments. They claim that “tiny shards of glass were embedded in all parts of their home, both inside and out, including their clothes, bedding, towels, appliances, carpet, tile, walls, tools, electronics, and inside their cars,” and that “tiny shards of glass were embedded in all parts of their home, both inside and out, including their clothes, bedding, towels, appliances, carpet, tile, walls, tools, electronics, and inside their cars.”
According to the plaintiffs, the discharge of the glass fibers caused dermatitis in all of the family members, and Durham had numerous shards of glass fiber removed from the back of his neck.
Furthermore, the plaintiffs claim that the degree of the family’s injuries is unclear since they may have swallowed a large quantity of glass fibers.
Chandler quickly took the mattress from their house to the outside after finding the source of the fibers, according to the plaintiffs.
According to the Zunis class action complaint, the family is currently staying in a hotel since they are unable to return to their house owing to the fiberglass contamination.
The glass shards in the mattresses, according to the plaintiffs, are for fire retardant reasons and are bigger than the kind of fiberglass used in home insulation.
“Exposure to glass fibers may cause eye, skin, and upper respiratory system irritation,” the plaintiffs add. The risk of harmful health consequences rises as glass fibers reach the bottom portion of a person’s lungs. The removal of glass fibers lodged in human skin may need surgical intervention.”
The plaintiffs claim that cleaning a home that has been exposed to glass fibers may cost tens of thousands of dollars, and that experts may advise occupants to leave the house until it can be properly cleaned.
According to the plaintiffs, the defendants in this class action case were aware of the risks of removing the mattress cover when they replied to a message board posting that removing the mattress cover might endanger the mattress’s systems.
The Zinus class action alleges that the firm does not include terms like fiberglass, glass fibers, or the fact that the mattress contains glass anywhere on the notice. Furthermore, the plaintiffs claim that the notice does not indicate that removing the outer cover may allow the mattress material to be discharged into the environment, resulting in severe harm to consumers.
The family claims that if they had known about the design flaws, they would not have bought the mattress or would have paid less for it.
According to the Zinus class action complaint, the defendants breached the Magnuson-Moss Warranty Act and are guilty of fraudulent concealment/fraudulent omission, as well as unjust enrichment.
“All individuals who bought an Affected Mattress in the United States, which was made by Zinus and contains glass fibers,” according to the lawsuit.
