Superior Refinery Explosion $1.05M Settlement

The Superior Refinery Explosion $1.05M settlement was a class action lawsuit that was filed against the Superior Oil Company in 2009. In 2015, the parties reached a settlement agreement which required the company to pay $1.05M to the plaintiffs and their attorneys.

Residents of Superior, Wisconsin, who were evacuated after the Superior Refinery explosion in 2018, may be eligible for a $1.05 million class action settlement. 

Anyone over the age of 18 who was subject to the evacuation order issued on April 26, 2018, as a consequence of the Superior Refinery explosion and fire is included in the Class.

Everyone within a three-mile radius east and west of the Superior Refinery, as well as within ten miles south, was ordered to evacuate.

In a class action complaint, plaintiffs claim that defendants Husky Oil Operations Ltd. and Superior Refining Co. LLC are responsible to community residents who were forced to leave the region and incurred economic losses, annoyance, and discomfort.

On January 1, 2021, Husky Energy became part of the Cenovus group of businesses. Cenovus, based in Calgary, Alberta, Canada, owns four refineries outright and has a 50% interest in three others, according to the company’s website.

 

The defendants dispute any allegations of misconduct and claim that any damages suffered by Class Members have already been compensated via a voluntary compensation scheme.

They agreed to the settlement, however, to avoid the danger, cost, and inconvenience of going to court.

The Court has not decided in either party’s favor.

After administrative fees and other expenses are paid from the settlement fund, Class Members who submit a valid claim will receive a payout.

Each claimant will be entitled for $150, with a family maximum of $300.

 

If the Superior Refinery reimbursement program makes payments to the Class Member or on his or her behalf, that amount will be removed from any settlement award the Class Member is due.

Depending on the amount of legitimate claims submitted, payments may be adjusted proportionally up or down.

On Dec. 22, 2021, a final hearing in the Superior Refinery explosion settlement will be held.

The deadline to opt out of the settlement or protest to it is November 3, 2021.
