GM Alleges ‘Hard Shift’ Transmission Defect

General Motors has issued a recall for 4.2 million vehicles after failing to fix an issue that can result in ‘hard shifts’. The defect was discovered by workers at the company’s transmission plant, but it took GM three months before issuing the recall.

General Motors is alleging that the “gm 6 speed transmission problems” are due to a defect. The company has filed a lawsuit against Ford Motor Company, accusing them of failing to disclose the alleged defect.

GM-Alleges-039Hard-Shift039-Transmission-Defect-Top-sIn a newly filed class action complaint, a group of customers claims that a flaw in the GM 8L90 and 8L45 gearboxes found in cars manufactured between 2015 and 2018 creates difficulties when drivers attempt to shift the vehicles.

In their class action complaint, the lead plaintiffs, all GM owners, claim that the 8L90 and 8L45 gearboxes are faulty, causing not just “rough shifts” but also engine damage. According to the lawsuit, GM owners and lessees would face rising repair expenses as a result of the claimed fault.

The GM class action complaint claims that when drivers try to accelerate or decelerate their vehicles, they experience a substantial shaking, shudder, jolt, clunk, or ‘hard shift’ when the automatic gearbox changes gears.

“The shuddering, shaking, jerking, and hesitating is caused by internal transmission and/or torque converter problems that cause friction surfaces, hydraulic systems, and gears to fail, resulting in metal shavings being cycled throughout the gearbox,” the complaint adds. “Damage to the transmission and torque converter happens over time.”

According to the GM class action complaint, the automaker has been aware of the claimed gearbox issue “for years.” The plaintiffs claim that GM has neglected to notify customers despite the fact that the corporation has published a technical service advisory regarding the problem.

 

“However, existing buyers and lessees should not have to wait for a remedy, and potential consumers should be informed of GM’s knowledge of a defect,” the plaintiffs say. “For the time being, it seems that GM is just biding its time until its warranty runs out.”

The claimed transmission issue, according to the GM class action complaint, poses a safety risk to drivers and passengers in GM cars equipped with GM 8L90 or GM 8L45 gearboxes from 2015 to 2018. According to the plaintiffs, the flaw may cause the vehicle to shake and jerk so violently that owners claim it feels like they’ve been struck by another automobile.

According to the plaintiffs, one GM owner claimed that the gear changed so violently owing to the alleged fault that he almost drove through his garage door.

The faulty transmission problem, according to the class action complaint, was caused by GM’s usage of an 8-speed gearbox beginning in 2015. According to advertisements published in 2014 regarding the change, the new 8-speed gearbox will distribute power more equally than the old 6-speed transmission — a “win-win-win scenario” for customers.

In six states: Florida, California, Illinois, New York, Oklahoma, and Texas, the GM class action lawsuit aims to protect owners and lessees of cars equipped with the GM 8L90 or GM 8L45 gearboxes.

The plaintiffs are represented by Cohen Milstein Sellers & Toll PLLC’s Theodore J. Leopold, Andrew N. Friedman, Douglas J. McNamara, and Julia A. Horwitz, as well as Gordon & Partners PA’s Robert Gordon and Steven Calamusa.
