Vivid Seats $7.5M Event Cancellation Settlement

The company agreed to pay $7.5M in settlement, which will be divided among the plaintiffs who filed suit against the company.

Vivid Seats, the company that owns and operates the popular ticketing service SeatGeek, has reached a settlement with customers who had filed complaints about their tickets.

  • For Class Members who were sent or emailed notice of this settlement as part of the additional notice procedure allowed by the Court in its July 15, 2021, decision, the time to file a claim has been extended to Nov. 10, 2021.

A $7.5 million class action settlement may be available to customers who bought tickets from Vivid Seats for events that were canceled owing to the coronavirus epidemic.

A Class Member is any person or entity living in the United States, its territories, or Canada who bought a ticket via Vivid Seats on or before April 1, 2021 for an event that was cancelled, postponed, or rescheduled and has not yet happened between Sept. 29, 2016, and April 1, 2021.

Early in the coronavirus epidemic, a class action complaint accused Vivid Seats of retroactively ending its long-standing “100% Buyer Guarantee,” which offers ticket purchasers with a legally mandated full cash return.

 

Vivid Seats is an online ticket marketplace for concerts, sports events, theatrical plays, and other forms of entertainment. Vivid Seats has tickets available for over 300,000 events, according to the company’s website.

Benefits of the Vivid Seats Settlement

Members of the class may submit claims for either a credit or a cash payout.

Some Class Members may have already received a credit toward the purchase of tickets for future events on their Vivid Seats account.

Any such active, non-expired credits will have their expiry date extended until December 31, 2022, per the terms of the settlement agreement.

To get this benefit, Class Members do not need to take any action.

 

Those who want a cash payout equivalent to the cost of the ticket (including the base price, fees, and delivery costs, but excluding insurance charges and any amount paid using a gift card, shop credit, or loyalty credit) must fill out a claim form.

Anyone who bought a ticket via Vivid Seats on or before April 1, 2021, for an event that was postponed or rescheduled between Sept. 29, 2016, and April 1, 2021, but was canceled before April 1, 2021, would be eligible for injunctive relief under the settlement agreement.

These Vivid Seats settlement Class Members will immediately be entitled to a credit on their account equivalent to 110 percent of the purchase price of the ticket or tickets they bought, minus any amount previously paid or spent in credit, for the purchase of tickets to future events. The credit will be good until December 31, 2022.

These Class Members may also elect to receive a cash reimbursement equivalent to their ticket purchase price, minus any amounts paid with gift cards or shop or loyalty credit, to the postponed or rescheduled event that was subsequently cancelled, less any amount previously paid or spent in credit. Class Members who want to receive this cash reimbursement must contact Vivid Seats within 21 days after receiving notification that the rescheduled or postponed event has been cancelled.

On Aug. 10, 2021, a final approval hearing will be held.

 

The deadline for Class Members to request exclusion from the settlement or to object to it is July 15, 2021.

A claim must be filed before August 30, 2021.
