A Catholic youth organization is facing a lawsuit from a man who claims that he was sexually abused by a priest in the 1980s. The alleged abuse took place while the plaintiff was in his early teens and he is now suing for damages.

Two sex abuse lawsuits have been filed against the former executive director of the Catholic Youth Organization, alleging that he sexually assaulted boys while coaching basketball at St. Joseph’s Church in Astoria in the 1990s.

Sexual Abuse Allegations in CYO Sports

Robert Caldera was the director of CYO athletics in Brooklyn until April 14, 2021, when he was fired. He is accused of sexually abusing adolescents while coaching CYO basketball at St. Joseph’s Church in the 1990s, according to two lawsuits filed in May 2021.

Caldera allegedly started assaulting plaintiff (referred to as J.K. in the complaint) when he was only 10 years old, according to the first CYO sports sexual abuse case. Caldera is accused of fondling J.K., grabbing his penis, and forcing J.K. to touch it. Caldera is also accused of masturbating in front of J.K. Rowling. 

From 1993 through 1998, J.K. was reportedly sexually abused approximately 24 times. According to the CYO sexual abuse complaint, the sexual activities took place on church grounds.

 

According to the second CYO sexual assault complaint, Caldera started sexually assaulting plaintiff M.T. when he was 15 years old. Similar accusations of sexual assault were made by M.T. three times between 1995 and 1998, according to him. 

M.T. claims he was sexually abused at St. Joseph Catholic Academy and on church grounds.

A father who reportedly became a coach to keep Caldera from seeing his children is named in the CYO sex abuse cases. Caldera, according to the parent, was always surrounded by youngsters and would often drive them about the neighborhood.  

The CYO sex abuse complaints claim that “at all relevant times, the Defendants knew or should have known that Caldera was unsuitable, dangerous, and a threat to the health, safety, and welfare of the children entrusted to his supervision, care, and/or protection.”

The New York Child Victims Act gives victims of child sexual abuse more time to file a lawsuit.

The two CYO sex abuse cases were brought under the New York Child Victims Act, which was enacted in 2019 and increases the time limit for filing claims by child sex abuse victims. They may now bring a civil action until they reach the age of 55, decades after they were abused. Victims over the age of 55 have a one-year grace period in which to make a claim.

 

Adult victims of child sex abuse who have been prohibited from filing a civil case due to the statute of limitations have until Aug. 14, 2021 to do so.
